The Kitchen Binder

Customer Service Agreement

Service Description

StillThere, LLC (the service provider) agrees to collect, transcribe, format, and organize recipes provided by the client into a custom, physical binder system. This includes:

·         Transcription of client provided recipes (handwritten, digital, printed, etc).

·         Standardized formatting for clarity and consistency

·         Printing and assembly into a binder with tabs and page protectors

·         StillThere Measurement Conversion chart included

This service does not include the creation, modification, or development of original recipes. StillThere, LLC does not provide any recipes as part of this service. StillThere, LLC does not provide The Kitchen Binder Service outside of the United States of America.

Personal Use Only

The Kitchen Binder service is intended for personal and household use only. StillThere, LLC does not provide publishing, mass reproduction, or commercial recipe distribution services.

Client provided Content

The client affirms that all recipes and materials submitted are either:

·         Owned by the client

·         Used with appropriate permission, or

·         Intended for personal or household use only

StillThere, LLC does not claim ownership of any recipes provided, and is not responsible for verifying the origin, ownership, or copyright status of submitted materials.

No Recipe Liability

StillThere, LLC is not responsible for the accuracy, completeness, safety, or outcomes of any recipes provided by the client, including but not limited to:

·         Ingredient measurements

·         Cooking times

·         Instructions

·         Cooking results

·         Allergy or dietary concerns

Recipes are transcribed and formatted as provided, with only minor adjustments for readability and consistency.

Physical Materials & Handling Risk

StillThere, LLC is only responsible for physical materials (handwritten recipes, books, or document) while they are in StillThere, LLC’s direct possession.  StillThere, LLC is not liable for any loss, damage, or delay occurring during shipping, transit, or while in the possession of third party carriers (UPS, FedEx, etc). Clients are encouraged to send copies or digital versions whenever possible to minimize risk of loss or damage. If original copies are required, the client is encouraged to use tracked and insured shipping methods for original materials.

Digital File Retention

StillThere, LLC may temporarily retain digital working files related to the project for backup and revision purposes (held for no more than 30 days after the completion of the project, unless otherwise agreed upon).  StillThere, LLC is not responsible for long-term storage or archival of client materials after project completion and delivery. Clients are encouraged to maintain their own copies of all submitted materials and completed files.

Shipping

Shipping costs, if applicable, will be communicated prior to project approval. Delivery timelines may vary based on carrier performance and other factors outside of the control of StillThere, LLC.  StillThere, LLC is not responsible for shipping costs. Local pickup options are available for anyone in the Las Vegas area.

Turnaround time

Estimated turnaround time is based on the number of recipes submitted and will be communicated prior to the start of the project. Delays may occur due to volume, complexity, or incomplete submissions.

Revisions policy

The client may request minor corrections (ie: typographical errors, formatting adjustments) within 14 days of delivery.  Substantial revisions, organizational changes, or additional recipes may incur additional fees.

Payment terms

Payment is required at start of work unless otherwise agreed upon. Due to the custom nature of the service, all payments are non-refundable once work has begun.

Custom nature of service

Each binder is custom built based on client submissions. Variations in formatting, layout, and organization may occur depending on the nature of the materials provided.

Limitation of Liability

This agreement shall be governed by the laws of the State of Nevada. StillThere, LLC’s liability is limited to the amount paid for the service. StillThere, LLC is not liable for indirect, incidental, or consequential damages.

Marketing Permission Clause

StillThere, LLC may request permission to photograph or showcase completed binders for marketing or portfolio purposes. No client names, private information, or recipe details will be shared without permission.

Force Majeure

StillThere, LLC is not responsible for delays or inability to perform services due to circumstances beyond reasonable control, including (but not limited to) natural disasters, illness, supply shortages, shipping disruptions, or technical failures.

Cancellation Policy

Clients may cancel a project prior to the start of work for a full refund. Once transcription, formatting, or production work has begun, payments become non-refundable due to the custom nature of the service.

Right to Refuse Service

StillThere, LLC reserves the right to refuse or discontinue service for projects or situations deemed inappropriate, unlawful, excessively abusive, or outside the scope of services offered.

Client Approval

By submitting recipes and / or making payment, the client agrees to the terms outlined in this agreement.
